This page (together with the documents referred to on it) sets out the terms on which Wilson Digital Media Limited trading as Online Ticketing ("we” or "us”) supplies any of the tickets ("Tickets”) listed on our website www.dayoutwiththomas.co.uk ("our site”) to you. Please read these terms carefully before ordering any Tickets from our site. By ordering any Tickets, you expressly agree to be bound by these terms.
You should print a copy of these terms for future reference.
Please check the box when ordering to indicate you accept these terms. If you do not accept these terms, you will not be able to order any Tickets from our site.
1. INFORMATION ABOUT US
1.1 - www.dayoutwiththomas.co.uk is a site operated and owned by WILSON DIGITAL MEDIA LTD trading as ONLINE TICKETING ("we”). We are registered in England and Wales under company number 06128759 and with our registered office at The Apex, 2 Sheriffs Orchard, Coventry, CV1 3PP.
2. YOUR STATUS
By placing an order through our site, you confirm that:
(a)You are legally capable of entering into binding contracts;
(b)You are at least 18 years old;
3. OUR STATUS
3.1 - As an authorised ticket agent, we sell Tickets on behalf of the operators of the events to which they permit entry ("Events”).
3.2 - Event operators may set terms and conditions applying to their Tickets which will also apply to you and your purchase of a Ticket and which you should carefully review. Full details are available by contacting Event operators.
3.3 - Our site may contain references or links to the websites of other companies, whether affiliated with us or not. We have no control over such sites, their content or products offered for sale on such sites and we cannot give any undertaking, warrantee, representation or guarantee as to their accuracy, satisfactory quality or lawful nature, and any such warranties are DISCLAIMED by us absolutely. This DISCLAIMER does not affect your statutory rights against such third parties. We will notify you when a third party is involved in a transaction, and we may disclose your customer information related to that transaction to Event operators.
3.4 - Tickets remain the property of Event operators and are personal revocable licenses which may be withdrawn and admission refused at any time where an Event operator considers it necessary having regard to the safety of the people attending an Event or others’ enjoyment of an Event or the proper operation of the Event.
3.5 - Tickets are sold by our site for personal use only and may not be resold.
4. AVAILABILITY AND DELIVERY
4.1 - When you order a Ticket from us, we will send you an email confirmation (Dispatch Confirmation) and only a Dispatch Confirmation shows that a Ticket is available and will be dispatched to you.
4.2 - Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation or as specified in our Delivery Guide
4.3 - We use Royal Mail postal services to deliver physical Tickets and Tickets will be at your risk from the time of dispatch.
4.4 - Once you have received your Dispatch Confirmation, holders of physical Tickets will be entitled to receive one free promotional Thomas & Friends storybook per order (subject to availability) which will be dispatched with your Tickets. For the avoidance of doubt holders of e-tickets shall also be eligible to request one free promotional Thomas & Friends storybook per order (subject to availability) by contacting us through the contact box on our site to arrange delivery.
5.1 Competitions and/or prize draws may also be hosted by HIT Entertainment Limited ("HIT”) from time to time. If there is a competition and/or prize draw taking place at the time you order a Ticket from us, your name will automatically be entered into that competition and/or prize draw, giving you the chance to win a prize.
5.2 The Golden Ticket Monthly Prize Draw (the "Prize Draw”) will take place between 1 August 2014 at 0.01am and 31 January 2015 at 23.59pm and the following terms and conditions shall apply:
(a) One winner will be selected at random on the 1st day of every month (for the preceding month).
(b) Each winner of the Prize Draw shall win a ‘Roaring Dino Run’ Fisher Price play set and Take-n-Play Fisher Price ‘Gator’ engine.
(b) Winners will be notified by email within 48 hours of being selected. If a winner does not respond to the notification email confirming their correct postal address within seven days then HIT reserves the right to select another winner.
(d) Entrants to the Prize Draw must provide their correct contact details in order to be notified should they win. It is your responsibility to ensure that you are able to accept the given prize in accordance with these terms and conditions.
(e) Prizes are non-transferable and there are no cash alternatives. HIT reserves the right to substitute the prize with any other prize of equal value.
(f) Winners may be required to submit valid identification before receiving their prize.
(g) By entering the Prize Draw, any winner agrees to allow HIT free use of their first name and general location (and with the winner’s permission only, their photograph) for publicity and news purposes during this and future promotions of Thomas and Friends by HIT.
(h) Other than death or personal injury arising from the acts or omissions of HIT and/or its affiliates will not be liable for any loss or damage arising out of the winner or their guest's enjoyment of the prizes.
(i) HIT reserves the right at any time to cancel, modify or supersede the Prize Draw (including altering prizes) at their sole discretion.
(j) Any questions regarding this Prize Draw may be directed to Customer Services at HIT’s postal address or at the following email address: firstname.lastname@example.org.
6.1 - The price of any Tickets will be as quoted on our site from time to time, except in cases of obvious error. Our site contains a large number of Tickets and it is always possible that, despite our best efforts, some of the Tickets listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a Ticket's correct price is less than our stated price, we will charge the lower amount when dispatching the Ticket to you. If a Ticket’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the Ticket, or reject your order and notify you of such rejection.
6.2 - We are under no obligation to provide the Ticket to you at an incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.
6.3 - The price comprises the face value of the Ticket and our booking fee.
6.4 - Our prices include VAT where applicable. Where we make an extra charge for secure or express dispatch services, this will be added to the total amount due as set out in our Delivery Guide. Ticket prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
6.6 - Payment for all Tickets must be by credit or debit card. We accept payment with most major credit and debit cards.
7. - OUR REFUNDS POLICY
7.1 - We regret that Tickets cannot be exchanged or refunded after purchase unless the scheduled Event is cancelled. We will not be responsible for lost or stolen Tickets.
7.2 - If an Event is cancelled, you will be offered tickets to any rescheduled Event (subject to availability) up to the face value of the Tickets or, if you are unable to attend the rescheduled Event or it is not rescheduled, a full refund of the price you paid. In order to claim your refund, please apply in writing to Wilson Digital Media Ltd, The Meridian, 4 Copthall House, Station Square, Coventry, West Midlands CV1 2FL. You must enclose your unused Tickets and this must be received within 28 days from the date of the cancelled Event. This does not affect your statutory rights.
7.3 - Tickets returned by you because of a defect will be replaced or refunded in full at our discretion, excluding the delivery charges for sending the item to you and the cost incurred by you in returning the item to us. We advise you check your Ticket on receipt.
8. - OUR LIABILITY
8.1 - Our liability in connection with any Ticket purchased through our site is strictly limited to the purchase price of that Ticket.
8.2 - This does not include or limit in any way our liability for death or personal injury caused by our negligence or other act or omission or for any matter for which it would be illegal for us to exclude our liability.
8.3 - We accept no liability for any losses which we cannot reasonably foresee at the time of making a sale of a Ticket, or for business losses.
8.4 - Where you buy any Ticket from an Event operator through our site, the seller's individual liability will be set out in the seller's terms and conditions.
9. - WRITTEN COMMUNICATIONS
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic, for example, we will contact you by e-mail or provide you with information by posting notices on our website.

11. - OUR RIGHT TO VARY THESE TERMS
11.1 - We have the right to revise and amend these terms from time to time.
11.2 - Your purchase of Tickets will be subject to the terms in force at the time that you place an order with us.
12. - THIRD PARTY RIGHTS
Gullane (Thomas) Limited may enforce these terms in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999 (the "Act”). Except for Gullane (Thomas) Limited, no third party shall have any rights to enforce these terms under the Act.
13. - LAW AND JURISDICTION
Contracts for the purchase of Tickets through our site will be governed by English law. Any dispute arising from, or related to, such contracts shall be subject to the exclusive jurisdiction of the courts of England and Wales.
